Terms of Service

1. Acceptance of Terms

By accessing or using the SmartyMeet platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and SmartyMeet Sp. z o.o., ul. Złota 59, 00-120 Warszawa, Poland.

2. Service Description

SmartyMeet is an AI-powered meeting intelligence platform that provides real-time transcription, automated summarization, action item extraction, and related features for meetings conducted via supported video conferencing platforms. The Service is provided on a subscription basis.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Record meetings without the knowledge and consent of all participants, as required by applicable law.
• Use the Service to process data of individuals without appropriate legal basis under GDPR or applicable data protection laws.
• Attempt to reverse-engineer, decompile, or extract proprietary AI models from the Service.
• Resell, sublicense, or commercially distribute the Service without written authorization from SmartyMeet.
• Use the Service to generate or distribute unlawful, harmful, or misleading content.

4. Meeting Data & Privacy

You retain ownership of your meeting data. By using the Service, you grant SmartyMeet a limited, non-exclusive license to process your meeting data for the sole purpose of providing the Service. We do not sell or share your meeting data with third parties. Our handling of personal data is governed by our Privacy Policy.

5. Intellectual Property

All intellectual property rights in the SmartyMeet platform, including software, AI models, user interface, and documentation, are owned by SmartyMeet Sp. z o.o. or its licensors. You retain all rights to content you create using the Service, including transcripts, summaries, and action items generated from your meetings.

6. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. SMARTYMEET DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TRANSCRIPTIONS WILL BE 100% ACCURATE. AI-GENERATED CONTENT SHOULD BE REVIEWED BY USERS BEFORE RELIANCE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMARTYMEET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Governing Law

These Terms are governed by Polish law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland. For EU consumers, mandatory consumer protection provisions of your country of residence also apply.
